    • An ultimate beneficiary is defined as:
      • A person who owns, controls, or benefits from a number of shares, units, or interests entitling them to exercise 25% or more of the voting rights.
      • A person who owns or benefits from shares, units or interests of the taxable person, having agreed to jointly exercise their voting rights with other persons and that agreement has the effect of giving them the ability to jointly exercise 25% or more of those rights, or a person who controls shares, units or interests of the taxable person in respect of which an entity has entered into such an agreement.
      • A person who owns or controls a number of shares or units with a value equal to 25% or more of the fair market value of the shares or units issued by the taxable person, or who benefits from such shares or units.
      • A person who has a direct or indirect influence such that, if exercised, it would result in de facto control of the person subject to it.
