Alaska Charitable Organization Annual Registration

Automatic Exemption

Exemption Eligible Organizations:
  • Churches or religious organizations that are not required to file federal annual information returns with the IRS
  • Candidates for national, state, or local office, and political parties, committees or groups that are required to file financial information with the Alaska Public Offices Commission
  • An organization that has a current gaming permit issued by the Alaska Department of Revenue pursuant to AS 05.15.100
  • Charitable organizations with no paid employees or board members that do not intend to raise or receive contributions, excluding government grants, in excess of $5,000 annually, or that do not intend to receive contributions from more than 10 persons annually.

Notes:

Exempt organizations may elect to submit a Notice of Exemption to notify the Department of Law.

A person who qualifies for an exemption must maintain for five years the records necessary to prove that the organization qualifies for the exemption.

  • One authorized signature required. Signatures need not be notarized.
  • Some Alaska counties and municipalities may require charities that solicit in-person to register prior to fundraising.
Before you Apply:

All Applicants:

  • Check the available exemptions to see if your charity is eligible for exemption from the full registration requirement.
How to Apply:

Domestic Applicants:

  1. File entity formation documents with the Division of Corporations, Business and Professional Licensing.
  2. Register as a charity with the Department of Law - Consumer Protection Unit. Pay the registration fee online to start. You will then receive an email containing a link to a page where you can complete the registration.

Foreign Applicants:

  1. Determine whether or not your charity will need to foreign qualify based on your activity in Alaska. If not required, skip to number 3.
  2. File foreign qualification documents with the Division of Corporations, Business and Professional Licensing.
  3. Register as a charity with the Department of Law - Consumer Protection Unit. Pay the registration fee online to start. You will then receive an email containing a link to a page where you can complete the registration.

Due Date Extension:

Alaska does not grant extensions for charitable organization registration. Use the most recent and complete financial information when filing the renewal.

Reinstatement

Not required



Formal Reinstatement is not required. Charities who wish to renew an expired registration should submit a renewal filing (if you have a current renewal code) with the most recent and complete financial information. Organizations will only pay one renewal fee. Organizations without a current renewal code must submit an initial filing with all required documents. 

Change of Fiscal Year

Not required



There is no need to notify the state of a change to an organization's fiscal year.

To close out your registration, email a written request and make sure to include the organizations name and federal tax ID number.

For the purposes of the registration requirement, a paid solicitor is a person who solicits contributions of money or other property for a charitable organization for compensation. The definition of paid solicitor does not include a bona fide salaried officer, employee, or volunteer of a charitable organization.

Alaska Paid Solicitor Registration

Note: Paid Solicitors must pay registration fees and file registration forms online, unless the Department of Law waives this requirement because the filer does not have reasonable access to the Internet, or to electronic equipment or software required to make the filing.

Penalties:

Failure to register with the Alaska Department of Law prior to soliciting charitable contributions for compensation is a class A misdemeanor, and subjects the person to civil penalties under the Alaska Consumer Protection Act (AS 45.50.471 - AS 45.50.561) of up to $25,000 per violation.

Notes:

A copy of a written contract for each charitable organization the paid solicitor contracts with to solicit contributions must be submitted when registering.

Required Attachments:
  • A copy of a written contract for each charitable organization the paid solicitor contracts with to solicit contributions. The contract must state the respective obligations of the paid solicitor and the charitable organization, including the amount to be paid to the paid solicitor.
  • A copy of all scripts used by the paid solicitor for fundraising in Alaska.
  • A ten thousand dollar surety bond (if renewing a registration, evidence of the continued bond must be submitted) on the Paid Solicitor Surety Bond form established by the department. The surety bond form sets forth the time period that a paid solicitor is required to maintain the bond and provides criteria for cancellation of the bond.
  • After a solicitation campaign is complete, a paid solicitor must submit a campaign financial report. The campaign financial report must be submitted on the Paid Solicitor Solicitation Campaign Financial Report form established by the department
