Is registration mandatory?: | Registration of an assumed name is required for most entities that plan to use a fictitious name. Sole-proprietorships that use an alternate name are required to file with the county clerk. |
Law: | KRS § 365.015 |
County Level Filing: | Only sole-proprietorships are required to apply for assumed name registration with the county clerk. Other entities may, however, be required to file a copy of their secretary of state assumed name application with the county clerk. |
Does registration prevent others from using the name I choose?: | Registration of an assumed name does not offer name protection, however, names must be distinguishable from all other names on record with the secretary of state. |
